Please read these Terms of Service ("Terms") carefully before using the Safety Case Flow website and services operated by Safety Case Flow Ltd.

1. Agreement to Terms

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access our services.

2. Description of Services

Safety Case Flow provides a digital platform and services for managing building safety compliance, particularly related to the UK Building Safety Act 2022. Our services include software for creating and managing Safety Case Reports, storing Golden Thread information, and providing support for building safety compliance.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and up-to-date information. You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.

4. Subscription and Payments

Some of our services are available on a subscription basis. You agree to pay all fees or charges to your account based on the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If you dispute any charges you must notify us within thirty (30) days after the date that we invoice you. We reserve the right to change our prices and payment terms at our discretion, provided that we will notify you before those changes apply to you.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Safety Case Flow Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Safety Case Flow Ltd.

6. User Content

Our services allow you to upload, store, and share content, including building information, safety documentation, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you upload, post, or otherwise make available via our services.

By uploading User Content, you grant Safety Case Flow a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in any existing or future media, for the purpose of providing and improving our services.

7. Limitation of Liability

In no event shall Safety Case Flow Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
